Seller
The Seller refers to Etelä-Konneveden Luontopalvelut Oy, which sells the products and services to the clients as distance selling with the trademark KalajaRetkeily on KalalajaRetkeily.fi website. The Seller is the seller of the products and services and the creditor of the Client.
Client
The Client is a private individual or a company, which buys products or services in KalajaRetkeily’s website. The client commits themselves to follow the terms and conditions of the sale when buying products and services from KalajaRetkeily’s website.
Ordering from KalajaRetkeily
General terms
- The prices presented on the website contain VAT.
- We sell products and services to over 18-year-old private individuals and corporate clients.
- We retain the right to changes in the prices.
- The Client is responsible for the correctness of the information they give.
- KalajaRetkeily has a right to use and give the registered address information to direct sale, distance selling and other direct sale and market and opinion research if the Client does not refuse it. The refusal can be done to the contact information mentioned in these Terms and Conditions
- We retain the right to change our delivery terms. The Client has to always before ordering familiarize themselves with the delivery terms valid at the time.
Booking terms
These terms are applied to rentable and reservable products and services. Combined, these are referred to as “object”.
Booking
- The Client is responsible for getting to know the description and guidance of the objects they book as well as the terms related to the booking.
- The booking made by the Client is binding when the order and/or payment confirmation has been sent to the email they have given.
- The Client pays the booking according to the payment method of their choice following the terms of the said payment method.
- The booking system sends an order and/or payment confirmation into the email given by the Client.
- KalajaRetkeily is not responsible for failed booking and the client must without delay contact KalajaRetkeily to fix the situation. In this case, KalajaRetkeily does not guarantee that the object will still be available. If the object is not available, the money will be returned or another object is offered as a replacement.
Cancellations and changes
- The cancellation day is the day when KalajaRetkeily has gotten the information of the cancellation.
- The Client is responsible for sending the cancellation early enough.
- If the Client cancels their booking,
- when there is 30 days or more to the beginning of the booking, the handling charge is charged for the booking. The handling charge is 10 € (including VAT 24%).
- when there is less than 30 days but a minimum of 7 days to the beginning of the booking, 50% is charged of the rental price.
- when there are less than 7 days to the beginning of the booking, the complete rental price is charged.
- the objects booked with discount codes are always charged with the full price in the event of cancellation despite the time of the cancellation.
KalajaRetkeily’s right to cancel a booking
- In the case of the act of God (force majoure), KalajaRetkeily can cancel a rental agreement or a booking. The cancellation is told to the Client who has booked the object without a delay.
- In the above-mentioned case, the Client has the right to get the whole rent they have paid refunded to them.
- The expenses born out of the cancellation of the rental agreement or the booking due to force majoure event will not be compensated.
The key codes of the self-service rental products
- Before the starting of the booking, the Client gets a text message containing the PIN number to the phone number given during the rental process. The PIN number opens the lock of the booked object.
- The PIN number will be given only to valid and paid bookings. The number cannot be given for outsiders.
- The Client locks the object when the rent time ends.
The special terms related to rental equipment
- The Client is responsible for familiarizing themselves with the equipment’s safety and usage guide. The equipment needs to be used carefully only in the ordinary use meant for it. The Client commits to making a security checkup during the rent time. The rental equipment cannot be taken from the country or rented onwards. The rental equipment can be used only to the extent allowed by these Terms and Conditions and only in locations suitable for the user’s skill-level and knowhow. The Client uses the equipment always at their own responsibility.
- When it comes to the water excursion equipment (for example canoes and kayaks), the Client guarantees themselves to be able to swim, have previous experience about the usage of the said equipment and be 18-year-old or older.
- The Client commits to following the safety guidelines given with the order.
- The Client must return the equipment in the same shape as it was when given to rent. The Client must immediately notify the Seller if the return is delayed. The Seller has the right to take 50% raised price from the exceeding time if nothing else has been agreed.
- The Client is responsible to repay the damages and expenses come to the rental equipment during the rent time due to careless or faulty usage or lacking repair. The Client is responsible to refund equipment broken or lost during the rent time to its replacement value. The Client is responsible to notify the Seller immediately of all the appearing flaws in the equipment.
- The Seller is responsible for the repair procedures following the normal wear of the equipment. The Seller is not responsible of the immediate or indirect costs or accidents happening to the Client due to the use or breaking of the equipment. The Seller does not committing to deliver new equipment to replace the broken one, nor to repay the Client the immediate or indirect costs caused by the interruption.
Delivery to the Southern Konnevesi National Park area
- The Client commits to following the guidance given by Finnish Forest and Park Service and the rules of the National Park
Complaints
- The possible complaints must always be done as soon as possible after the appearance of their cause.
- In the case that the matter or repay demand related to it is not solved satisfactorily, must the complaint be sent in a written form during a month from the end of the rent time or the service.
- KalajaRetkeily aims to handle the complaints as fast as possible but at always in a month.
- If the Client and KalajaRetkeily will not get into an agreement, the client can take the disagreement to the consumer complaint board to handle.
- KalajaRetkeily does not repay costs or damage come to the Client from the natural environment, such as bugs, animals, potholes or unexpected change in the weather.
Group buy
KalajaRetkeily.fi includes products, which the CIient can buy as a conditional group buy. This means that the Client orders a product or a service immediately with a credit card (Stripe as the forwarder of the payment), but the price is charged from the Client’s card just when a condition defined by KalajaRetkeily is fulfilled or KalajaRetkeily decides to carry on the trip despite the conditions.
Formation of an agreement in a group buy
- The agreement binding the Client takes effect when the order has been confirmed (confirmation of order). This happens when the client fills their credit card information to the service, agrees to the terms and conditions and clicks ‘order’. Immediately after this, the Client gets a confirmation of order from the online store into their email.
- The bill of sales binding the Seller is created when the term has been fulfilled and the price has been charged from the Client’s card.
- The bill of sales is always between the Seller and the Client. The Seller information is clearly provided during the ordering process and in the confirmation messages.
- The confirmation messages are delivered to the Client by email.
Cancellations in a group buy
- The cancellation day is the day when KalajaRetkeily has gotten the information of the cancellation.
- The Client is responsible for sending the cancellation early enough.
- If the Client cancels their order before the fulfilment of the conditions, KalajaRetkeily charges the handling fee of 10 euros (including VAT) from the client.
- If the Client cancels their order after the fulfilment of the conditions of the group buy and after the charge has been made from the card, the normal cancellation terms and conditions are applied (see booking and delivery terms).
KalajaRetkeily’s right to cancel a group buy
- Group buys which conditions are not fulfilled on time limit, are cancelled automatically without a separate notice in the online sales system after the end of the time limit. Cancellation does not cause and expenses to the Client.
- KalajaRetkeily can also cancel a group buy without a separate notice until the conditions set for the group buy (for example time limit, a minimum amount of participants) are fulfilled.
- If the agreement has been created, meaning that KalajaRetkeily has charged the group buy from the Client’s card, cancellation happens following the normal terms and conditions of cancellation.
Terms of delivery
Birth of an agreement
- The binding agreement comes to term when the order has been confirmed (confirmation of order/payment).
- The confirmation of order/payment is delivered to the Client by email.
The cancellation of sales and return
- The products on sale have a right to return for 14 days as imposed by the Consumer Protection Act.
- The right to return is valid only if the product is in the shape corresponding with a new product.
- Also, possible packaging must be suitable for sale.
- Contact the sales to get more details instructions about returns.
- The right to return does not involve carved or other individual products, accommodation services, restaurant services or other services for leisure time agreed for a specific time.
- The Client is responsible for the normal expenses of the return.
Product guarantee
- We follow the guarantee clauses defined by the manufacturer or the importer.
Delivery
- The handling charge includes the mailing and packaging fees. You can check the handling charge after you have chosen the payment and delivery method from your cart.
Payment terms
- KalajaRetkeily uses credible and safe payment transmitters in their services.
- KalajaRetkeily ei tallenna asiakkaan pankkiyhteys- tai luottokorttitietoja missään vaiheessa.
- KalajaRetkeily does not save the Client’s banking contact or credit card information at any point.
- The Client agrees to follow the terms and conditions of the payment method of their choice.
- Paying by the bill (for companies and organizations)
- Billing is done by a bill send via email.
- Billing is only for the use of companies and organizations.
- The bill must be paid by the date marked into it.
- To the bills paid after the due date is always added delay charge. If the bill has been paid after the due date with the original bill and the delay charges have already been created, the charges are billed separately.
- Stripe as the payment transmitter
Stripe is an international payment transmitter, through which you can pay with the following credit cards: MasterCard, Visa, American Express. See the terms and conditions of Stripe.
- The payment transmitter of the online store is Maksukaista (Paybyway Oy, business ID: 2486559-4), which has registered of the Financial Supervisory Authority (FIN-FSA). In the bank statement and in the bill the receiver of the payment is shown as Maksukaita / Paybyway Oy. Maksukaista transmits the payment to the online seller. Paying is safe because all the information related to the payment event is transmitted via a secured connection so that no outside parties can see the payment event information. The sale is done between the Client of the online store and the online store. The online store is responsible for all the responsibilities related to the sale.
